What this place is

The HOA, the board and the management company are three different things, and knowing which is which tells you where a question should go — it is the thing most people here have backwards.

“Jamacha Greens” means three things

The HOA, the Board, and the Management Company are three separate concepts, and the one you likely interact with the most is the one with the least power to change things.

1) The HOA: 192 units and their owners

If you own a unit at Jamacha Greens, you were made a member of the HOA the day you took title: the owner of a unit “shall automatically, upon becoming the owner of same, be a member of the Association” and remains one until “his ownership ceases for any reason” (Declaration H.7). Nobody joined and nobody can resign. One unit, one vote (Bylaws Art. II § 1).

So there is no “them” to appeal to that is not also partly you. The dues are the members’ money, the common area is the members’ property, and the documents are the members’ documents. “The HOA” is all the owners, together.

2) The Board: Five owners who govern the HOA

The affairs of the Association are “governed by a Board of Directors composed of five persons, all of whom must be owners of condominiums in the project” (Bylaws Art. IV § 1).

Owning a unit is the test, not living in one — a director may live here or may be one of the absentee owners, and the Bylaws do not distinguish. The dues, the rules and the contracts are theirs.

3) The Management: A vendor, hired by the Board

The board “may employ for the Association a management agent… to perform such duties and services as the Board shall authorize” (Bylaws Art. IV § 5).

Pernicano Realty & Management sends the statements, the notices and the violation letters, and answers the phone. They don’t make the decisions — the Board does. A great many disputes here are an owner arguing with a company that has no power to give them what they are asking for, about a decision it did not make.

If you rent here

Voting power only belongs to owners (Bylaws Art. II § 1), but every decision still arrives at your door. The rules about parking, trash, pets, quiet hours and the pool apply to residents, not to owners, so most of this section is as much yours as anybody’s.
